POLICY AND PROCEDURAL CHANGES in 1998

Registrant's Mailing Address. Registrants are reminded that the Registration Branch mails all documents concerning pesticide product registrations to the firm (registrant) shown on the certificate of registration (license) - at the firm's address on the license. The registrant is the same as that registered with U.S. EPA, with the exception of a subregistrant. Additional information is found in California Notice 97-6.

Concurrent Reviews. Effective January 1, 1999, DPR implements concurrent review (with U.S. EPA) of certain antimicrobial products. This change was required by law (SB464) and expands the types of products allowed to be submitted concurrently. Already allowed to be submitted concurrently are products designated for U.S. EPA-reduced risk review, new active ingredient microbials, and new and current active ingredient biochemicals. Included are label amendments to microbial products and, as allowed by the branch chief, other microbial and biochemical products. Details are in California Notice 98-8.

Liquid Chemical Sterilants. The law (SB365) gave DPR the authority to exempt certain liquid chemical sterilant products from registration, if regulations were put into place. The regulations are now in effect. Details of the criteria for exemption of liquid chemical sterilants defined as critical and semicritical medical devices are in California Notice 98-5.

Product Chemistry Summaries. Certain product chemistry information may be submitted by applicants and registrants to DPR in summary form. This is in accord with U.S. EPA's PR-Notice 98-1 (pdf). The exception is product storage stability data for microbial products (unless consisting of killed organisms); submission of the study is still required. Details of DPR's policy are found in California Notice 98-6.

Pet Product Labels. Registrants are reminded that pet product labels released for shipment after October 1, 1998 must bear the label changes required in U.S. EPA PR-Notice 96-6 (pdf). These label amendments must be submitted to DPR for approval prior to release for sale.

Reevaluation. Reevaluations of several currently registered active ingredients have been underway. Included are cyfluthrin, thiophanate-methyl, chlorthal-dimethyl, volatile organic compounds (VOCs), and tuberculocides. For details on the status of each reevaluation, please contact this office.

Nonrenewal of certain AB2021 products. Several products
will not be renewed due to AB2021 (Pesticide Contamination Prevention law) data gaps. The products are for agricultural uses of trichlorfon and methiocarb. Affected companies have already been notified.

Information available on DPR Home Page. More information than ever is available on DPR's home page at www.cdpr.ca.gov You may access many data bases, including completed medical toxicology summaries which are now available online. Information is updated regularly.

New laws and regulations in California. Passed into law in 1998 or effective in 1998/1999.

- Concurrent submission of certain antimicrobial products allowed as described above. Also see DPR's home page for law text.

- Liquid chemical sterilant products defined as medical devices do not require registration by DPR. See above description. Law and regulation text is on DPR's home page.

- Devices intended to control structural wood-destroying pests now require DPR registration by July 2001 - or sale becomes unlawful. See DPR's home page for law text.

Proposed regulations on efficacy data. DPR has again proposed regulations to exempt agricultural products from submission of efficacy data. See DPR's home page for proposed regulation text and the deadline for public comment.

The passage of SB445 in California authorized DPR to exempt certain federally-exempt products from registration. However, until regulations are in place in California, these pesticides continue to require registration by DPR. Watch DPR's home page for any proposed regulations and deadlines for public comment.
